Mediation and Alternative Litigation 2017/2018

Objectives

To frame and contextualize the Alternative Dispute Resolution (ADR) in the construction of alternative justice, in the sense of informality;
Study the Alternative Dispute Resolution types, as conciliation, mediation and arbitration, recognizing the advantages and disadvantages;
Contextualize the Peace Court in the Alternative Dispute Resolution and know the procedural principles; Expose and analyse, critique and deeply the procedure of processes on the Peace Court, recognizing all phases and procedural rules.
Know Voluntary Arbitration’ and Mediation' regime

Teaching Metodology

The teaching methodology is based on: theoretical exposition of the matter and in the analysis and interpretation of the law: study of doctrine and jurisprudence; critical perspective of matter, application to concrete cases and discussion and resolution of practical cases.

Demonstration of the teaching methodologies coherence with the curricular unit's objectives

The unit of Alternative Dispute Resolution is fundamentally practice but must be combined with a theoretical view of concepts. It is the combination of theoretical and practical aspects that results in acquisition of necessary skills and determinate the achieve of goals set.
The uc starts with the analysis of concepts and exposition of legal regime and then is done the practical application of it. Thus, beyond the theoretical framework underlying the unit are presented for many practical cases.
Students should be able choose the ADR, use in concrete cases and follow the procedural formalities in each one.
